Mother Ocean Fund (MOF) and its affiliated companies Aquatic Tribe (AT) are committed to respecting the privacy of customers – including participants of Diveschedules.com.
Mother Ocean Fund Corp (MOF) and/or Aquatic Tribe (AT) understand that your privacy is important to you and is committed to respecting and protecting your personal data, which is any information that is capable of identifying you as an individual person. This Privacy Policy covers personally identifiable information that may be provided to or obtained by MOF and/or AT during such interactions and describes how it will handle and protect your personal data in connection with your interactions with MOF and/or AT, in its capacity as data controller. Please see also the Terms of Service associated with the various MOF and/or AT sites, apps and programs for more information about MOF and/or AT general terms and policies.
MOF and/or AT may also automatically collect information about the devices you use to interact with MOF and/or AT websites. The information automatically collected may include IP address, device identifier, web browser and browsing information collected through cookies, web beacons, pixels, clear gifs and other similar technologies (collectively “Cookies and Other Tracking Technologies” and “Cookies”) on MOF and/or AT sites. MOF and/or AT may also automatically collect information about how you use the sites, such as what you have searched for and viewed. The information automatically collected will be associated with any personal data you have provided.
Use of Information
The personal data MOF and/or AT collects may be used however your specific consent allows, or other legal bases for processing and using such information. In some situations, the collection of personal data may be required for the operation of the sites or to provide certain services or products. MOF and/or AT uses your personal data to:
- Fulfill your requests for information
- Process your requests to participate in training programs and other activities
- Evaluate and improve MOF and/or AT services
- Distribute safety alerts, newsletters, and diver training-related correspondence and materials to you

MOF and/or AT may keep any of your personal data on file and use it to contact you.
MOF and/or AT may use first- and third-party Cookies and Other Tracking Technologies to manage its sites and its services, and to collect analytics about how you use them. The information provided throughout this Privacy Policy about Cookies also applies to these other tracking technologies. Specific Program Use Considerations
Participants in Training Programs
What information does MOF and/or AT obtain?
For participants in events, MOF and/or AT may obtain the participant name, mail address, telephone number, email address, gender, birth date, certification/participation date, certification level, associated MOF and/or AT Member name(s) (individual professional and business members), and member number(s).
How is the information used?
MOF and/or AT will use participant information in the MOF and/or AT quality management process, in which participants may be sent program evaluation forms and related correspondence. The information will also be used to send participants the appropriate event participation materials, as well as for dive safety-related alerts and for research and statistical purposes.
Additionally, participant information may be used by MOF and/or AT to promote additional marketing programs and opportunities. Further, from time to time, participant information may be provided to industry partners for the purpose of promoting diving, training and dive-related products and services that MOF and/or AT feels may be of interest to participants. MOF and/or AT will not, however, mail to participants who are not members for the purpose of directly selling Diveschedules.com services, products or programs in competition with MOF and/or AT Retailers/Resorts. Further, MOF and/or AT will not sell, trade or lease divers’ names and addresses to any third party for the purpose of selling or promoting any product in competition with MOF and/or AT Retailers/Resorts, except with prior notice and voluntary participation by the individual MOF and/or AT Retailers/Resorts.
Participant information may also be provided to Mother Ocean Foundation, a nonprofit organization, for the purpose of its providing environmental information, ocean clean up initiatives and opportunities.
Registration, Facilities, and Payment
What information does MOF and/or AT obtain?
When you register with MOF and/or AT, your personal information is tracked in a database and is accessible by your chosen Facility and its affiliated. In addition, your certification data and other performance standards are collected. These data are also accessible to these same entities.
The credit card transaction information (mailing address, credit card number, credit card expiration date and phone number) used in for your MOF and/or AT is processed on a secured third party payment vendor and is neither accessible nor made available to your facility, dive groups, dive charters instructor, or any of its commercial partners. This information is only accessible by MOF and/or AT.
When you submit personal information via MOF and/or AT, you understand and agree that this information may be transferred across national boundaries and may be stored and processed in any of the countries in which MOF and/or AT and their affiliates and subsidiaries maintain offices, including without limitation, the United States. You also acknowledge that in certain countries or with respect to certain activities, the collection, transferring, storage and processing of your information may be undertaken by trusted third-party vendors.
How is the information used?
Email addresses are collected from those who communicate with MOF and/or AT, such as from site registration. Notwithstanding the information provided in other parts of this Privacy Policy, MOF and/or AT will not share any information with third parties unless they have agreed to maintain the confidentiality, security, and integrity of the personal information they obtain from MOF and/or AT. MOF and/or AT may also share aggregate or summary information regarding its users with partners or third parties. These activities will be undertaken in accordance with governing laws and regulations and will not disclose individual information.
In addition, MOF and/or AT allow the facility or instructor to upload content to the site for viewing by MOF and/or AT users. MOF and/or AT cannot be held accountable for files uploaded by third parties that result in software problems or the transmission of viruses.
By using MOF and/or AT, and providing verifiable parental consent, you agree to the collection and use of the information you (and your child, with your permission) provide to MOF and/or AT as described in this Privacy Policy statement. If MOF and/or AT decide to change its privacy policy, it will post those changes on this page so that you are always aware of what information MOF and/or AT collects, how it is used and under what circumstances MOF and/or AT will disclose it. As MOF and/or AT implements new technology and introduces new services, this Privacy Policy will be updated, so MOF and/or AT encourages you to review it often.
Special Considerations Regarding Children Younger Than Thirteen Years of Age / Sixteen Years of Age in the EU
Diveschedules.com collects participant information regarding children younger than 13 years of age / 16 years of age in the EU who participate in events, with such participation requiring parental approval. Except for the purposes of providing program completion materials and administering the MOF and/or AT Quality Management process, information from such children is kept private, is not used by MOF and/or AT and is not provided for use by any third party at any time.
While MOF and/or AT cannot prevent children younger than 13 years of age / 16 years of age in the EU from viewing the MOF and/or AT websites, such children may not use or register for the services offered on the sites. MOF and/or AT strongly encourages parents and guardians to supervise the activity of all children younger than 18 years of age in their use of the internet. MOF and/or AT is compliant with the Children’s Online Privacy Protection Act of 1998 (COPPA). For more information on COPPA, visit: http://www.coppa.org.
Visitors to and Users of MOF and/or AT Apps
What information does MOF and/or AT obtain?
When someone registers on MOF and/or AT or uses MOF and/or AT Apps, the following information may be obtained: email address, name, mail address, phone number, personal, DOB, demographic information, etc. In some instances, registrants may decide what information they choose to provide. Sometimes, however, complete information is needed for MOF and/or AT to respond to requests and/or include registrants in contest eligibility, etc.
What does MOF and/or AT do with the information?
MOF and/or AT treat the information from visitors to MOF and/or AT or the MOF and/or AT Apps differently than the information gathered from participants who register for events (as described above). For Site/App visitors, MOF and/or AT may gather information for the sole purposes of identifying visitors and their interests, aggregating demographic data, providing personalized notices and promotions, and improving the site/Apps. MOF and/or AT may provide, market, trade or sell the information it obtains from such site/App visitors to third parties, except in the aggregate as part of statistical reports prepared by Diveschedules.com for industry analysis; such aggregate information does not include identifying information. An exception to this would involve sign-ups for certain promotions, sweepstakes offers, etc. that may include the sharing of certain data with MOF and/or AT industry partners, for the purpose of providing diving-related information and opportunities (such intended uses would be disclosed within the specific program information provided on MOF and/or AT App).
Email addresses may be collected from those who communicate with MOF and/or AT and/or a MOF and/or AT App. Notwithstanding the information provided in other parts of this Privacy Policy, MOF and/or AT will not share any information with third parties unless they have agreed to maintain the confidentiality, security and integrity of the personal information they obtain from MOF and/or AT. MOF and/or AT may also share aggregate or summary information regarding its users with partners or third parties. What does MOF and/or AT use to track information from users?
MOF and/or AT uses various standard web-measuring tools to trace MOF and/or AT visitor movements through the site, such as Silverpop and Google Analytics (a web analytics service provided by Google, Inc.).
Google Analytics uses Cookies to collect and record information about visitor behavior on Mother Ocean Fund.com / Aquatic Tribe App. Google Analytics stores information about what pages visitors visit, how long they are on the site, how they got here and what they click onto. This data is not tied to personally identifiable information, such as your name or address, so this information can’t be used to identify who you are. Diveschedules.com has turned on Google Analytics Demographics and Interest Reporting to get an idea of user’s demographics and interests. You can use the Google Analytics Opt-Out Browser Add-on to disable tracking by Google Analytics.
Service Providers
MOF and/or AT may give visitors’ information to the people and companies that help MOF and/or AT provide its services. For example, outside vendors may be used to help host the website, host photos and videos, process payments or provide search results, and, in some cases, MOF and/or AT may provide a service jointly with another company. When working with third parties in these ways, MOF and/or AT will enter into confidentiality agreements through which the vendors agree to only use visitor information in a manner consistent with MOF and/or AT Privacy Policy. However, if MOF and/or AT were to use a third party not bound by such a confidentiality agreement in the future, the third party will be identified. In such a case, it is the responsibility of the user to read and consider the third party’s Privacy Policy/Terms and Conditions prior to accessing that feature or function.
Advertising
MOF and/or AT does not share individual visitor information with advertisers. After an ad runs, MOF and/or AT may provide advertisers with reports on how their ads performed; for example, reports telling advertisers how many users saw or clicked on their ads. Some advertisers may place Cookies on a visitor’s computer.
Closing Personal Accounts
Registered users may close their accounts at any time. Once the account is closed, the personal information within it is no longer accessible. However, the data will continue to be included within compilations of anonymous information, in which no individual information is identifiable.
Other Important Information
Can I Decide What Information to Receive From or Through MOF and/or AT (i.e., Opt-Out)?
Yes. Except for the information that is used to send participants of events the appropriate completion materials, and materials used in the Quality Management process, in which participants may be sent program evaluation forms and related correspondence, anyone can elect not to receive any information, or to receive only certain types of information. To change your preferences, please contact your MOF and/or AT Regional Headquarters.
Limits on MOF and/or AT Abilities to Protect Personal Information
Your privacy is very important to MOF and/or AT. However, due to the existing legal and technical environment, MOF and/or AT cannot ensure that your personally identifiable information will not be disclosed to third parties in ways not described in this Privacy Policy. For example, MOF and/or AT may be forced to disclose information to the government or third parties under certain circumstances, or third parties may unlawfully intercept or access transmissions or private communications. Additionally, MOF and/or AT can (and you authorize MOF and/or AT to) disclose any information about you to private entities, law enforcement or other government officials as MOF and/or AT, in its sole discretion, believes necessary or appropriate to address or resolve inquiries or problems.
Cookies
MOF and/or AT uses Cookies and similar technologies like pixels and tags to ensure that visitors have the best possible experience on padi.com and other sites. A Cookie is a small amount of data that is transferred to your browser by a web server and can only be read by the server that gave it to you. It functions as your identification card, recording your passwords, purchases and preferences. It can’t be executed as code or deliver viruses.
Most browsers are initially set to accept Cookies. You can set your browser to notify you when you receive a Cookie, giving you the chance to decide whether or not to accept it. (For some web pages that require an authorization, Cookies are not optional. Users choosing not to accept Cookies will probably not be able to access those pages, and may be precluded from ordering or from maintaining an account on the site.) If you use padi.com or other Diveschedules.com sites without changing your browser settings, MOF and/or AT will assume that you’re happy to receive all Cookies on the website.
Trusted partners like DoubleClick help MOF and/or AT serve advertising on and off Diveschedules.com sites. Analytics companies like Google Analytics, Facebook, Yieldmo and Silverpop may also place Cookies on your machine. Please read their privacy policies to ensure that you’re comfortable with the manner in which they use Cookies.
What types of Cookies do MOF and/or AT use?
MOF and/or AT use two types of Cookies – persistent and session.
- Persistent Cookie: set once you’ve logged in to your MOF and/or AT account. The next time you visit a MOF and/or AT website using the same device, it recognizes you as an existing user.
- Session Cookie: used to identify a particular visit to the website. Session Cookies expire after a short time, or when you close your web browser.
When does MOF and/or AT put Cookies on your device?
Cookies may be set by MOF and/or AT when you visit a MOF and/or AT website, or they may be set by other websites or services who run content on the page you’re viewing (known as third-party Cookies).
How are Cookies used on MOF and/or AT websites?
Cookies can be used to recognize you, store your preferences, improve your experience, support security, and personalize content and ads. Additionally, Cookies allow MOF and/or AT to bring customized features to you through MOF and/or AT plugins such as the share button.
MOF and/or AT uses Cookies for a number of additional purposes, including:
- Security – support/enable security features and help detect malicious activity and violations of User Agreements.
- Preferences, Features and Services – remember language and communication preferences, help you fill out forms, and provide features/insights/customized content.
- Advertising – show relevant advertising on and off padi.com and other sites; measure ad performance; and work with partners.
- Performance, Analytics and Research – understand and improve products, features, and services across devices and contexts.
Most browsers allow you to control Cookies through their settings preferences. Limiting the ability of websites to set Cookies may worsen your overall user experience.
Does Diveschedules.com track IP addresses?
As part of the statistical tracking of MOF and/or AT sites, information about visitors’ devices and browsers are collected, such as browser version and type, IP address, website referred from and country of visitor.
GPS Data
When MOF and/or AT obtains information concerning an individual’s location through GPS data, such as when certain custom MOF and/or AT search engine functions that show the nearest partners Dive Center or Resort are accessed, the information specific to the user is utilized by MOF and/or AT solely for that purpose and is kept by MOF and/or AT only long enough to provide the specific service used. Aggregate information, which does not include any individually identifiable data, is compiled, however, for the purpose of establishing trends, search frequency, regional activity, etc.
Use of Information Collected Via Mobile Devices
In connection with its mobile applications, MOF and/or AT may use third-party service providers to analyze non-personally identifiable user activity to fix errors, monitor usage and improve the performance of the mobile applications. For example, MOF and/or AT receives reports on some of its mobile applications’ aggregate usage and browsing patterns, including information about the type of device used, articles accessed and other events occurring within MOF and/or AT apps. MOF and/or AT also receives reports on certain errors occurring within mobile applications. None of these third party service providers gathers information in a manner intended to identify any particular user personally.
Data Recipients and International Data Transfers
Personal data collected on the MOF and/or AT sites may be transferred from time to time to MOF and/or AT subsidiaries and affiliates and their personnel across the global organization, as well as to MOF and/or AT third-party service providers located throughout the world, including in countries where the local law may grant you fewer rights than you have in your own country. Additionally, user data may be viewed and hosted by MOF and/or AT and its third-party service providers anywhere in the world. Where required by law, MOF and/or AT has put in place legal mechanisms designed to ensure adequate data protection of your personal data that is processed by MOF and/or AT subsidiaries, affiliates and third- party service providers, including the transfer of your personal data to countries other than the one in which you reside. If you would like more information about these legal mechanisms, which may include the EU’s Standard Contractual Clauses, please contact your regional MOF and/or AT office at the addresses below. By using any of the MOF and/or AT services and sites and providing information to any of them, you voluntarily consent to such trans-border transfer and hosting of such information.
MOF and/or AT will not intentionally disclose or transfer (and will take reasonable steps to prevent the unauthorized or accidental disclosure of) your personal data to third parties without your consent, whether for such third parties’ own marketing purposes or otherwise, except as follows: MOF and/or AT may provide access to your personal data to third-party service providers engaged by MOF and/or AT to provide services related to programs, services, product and sites, provided that such third- party service providers will first agree to maintain the strict confidentiality of such information and provide the same level of data security as provided by MOF and/or AT.
MOF and/or AT may also share your personal data with third-party service providers who perform services and functions on MOF and/or AT behalf to support interactions with you, including, for example, processing Training Program documents, administering surveys and contests or communicating with you. These third-party service providers are not permitted to use or disclose your personal data except as necessary to perform services on MOF and/or AT behalf or to comply with legal requirements.

User Forums
You should be aware that whenever you publicly disclose information online, that information could be collected and used by others. MOF and/or AT is not responsible for any action or policies of any third parties who collect information that users publicly disclose in any such forums on the Sites.

MOF and/or AT sites may provide links to third-party websites or information as a service to users. If you use these links, you will leave the MOF and/or AT sites. Such links do not constitute or imply an endorsement, sponsorship or recommendation by MOF and/or AT of the third party, the third-party website or the information contained therein, and MOF and/or AT shall not be responsible or liable for your use thereof. Social Networking
The MOF and/or AT websites may allow you to sign into and associate your social network accounts including, but not limited to, Twitter, LinkedIn, Facebook, and YouTube, with MOF and/or AT. The sites and programs also may allow you to log in to a MOF and/or AT account using certain social network account credentials. By associating your social network account with MOF and/or AT or logging in to a MOF and/or AT account using your social network account credentials, you give MOF and/or AT permission to access information that you have made available in your public profile for that social network account. The information available in your public profile varies based on the social network and your settings but may include your email address, real name, profile picture, gender and location. If MOF and/or AT uses such information received from your social network account, any such use will be carried out in accordance with the social networks’ privacy policies and terms of use, which go into effect at the point of such contact; as well as this Privacy Policy. Please refer to the privacy settings in your social network account for information about what data may be shared with MOF and/or AT and other connected applications, and to manage the data that is shared through your account, including information about your activities using MOF and/or AT websites and programs.

Security
MOF and/or AT has implemented generally accepted standards of technology and operational security to protect personal data from loss, misuse, alteration or destruction. Only authorized MOF and/or AT personnel and third- party service providers are provided access to personal data, and these employees and service providers are required to treat this information as confidential. Despite these precautions however MOF and/or AT cannot guarantee that unauthorized persons will not obtain access to your personal data.
When you begin a checkout or redemption process within MOF and/or AT sites, MOF and/or AT requires that a secure connection between your computer and Diveschedules.com server(s) be established. To do this, MOF and/or AT sites utilize a technology called Secure Socket Layers (SSL). SSL encrypts your personal and credit card information before it travels over the Internet. SSL technology is the industry standard for secure online transactions. Because Diveschedules.com uses SSL, registering on MOF and/or AT, for example, is just as safe as providing your credit card number over a telephone. SSL is an industry standard with advanced encryption technology that works with current versions of Internet Explorer, Chrome, Firefox, Safari and numerous other web browsers. A secure connection is maintained until the checkout process is either completed or canceled by the user.
Although MOF and/or AT uses such industry-standard efforts to safeguard the confidentiality of your personally identifiable information, “perfect security” does not exist on the Internet.
MOF and/or AT Data Retention Policy
MOF and/or AT retains personal data, as necessary, for the duration of the relevant relationship. MOF and/or AT may also retain personal data for longer than the duration of the relationship should it be needed to protect MOF and/or AT against legal claims, for analysis or historical record-keeping or to comply with MOF and/or AT information management policies and schedules. If you request that MOF and/or AT delete your personal data, MOF and/or AT will make reasonable attempts to delete all instances of the information in their entirety. Different laws may prevent MOF and/or AT from providing access to your personal data or otherwise fully complying with your request, depending upon the circumstances and the request, such as for example, where producing your information may reveal the identity of someone else. MOF and/or AT reserves the right to charge an appropriate fee for complying with your request where allowed by applicable law, and/or deny your requests when they may be manifestly unfounded, and/or excessive, or otherwise objectionable or unwarranted under applicable law.

Consent – Changes to the Privacy Policy
By using MOF and/or AT programs, services and websites, you consent to the collection, use, and storage of your personal data by MOF and/or AT in the manner described in this Privacy Policy and as disclosed elsewhere associated with MOF and/or AT individual programs, services and websites. As has been referenced within this document, the information provided during various types of interactions may be treated differently. MOF and/or AT reserves the right to make changes to this Privacy Policy from time to time and will alert you to any such changes by updating this Privacy Policy. You are further informed, understand and agree that the business activities of MOF and/or AT Members are independent, and are neither owned nor operated by MOF and/or AT. While MOF and/or AT establishes the standards for MOF and/or AT diver training programs, it is not responsible for, nor does it have the right to control, the operation of the MOF and/or AT Members’ business activities or the day-to-day conduct of MOF and/or AT Members or the supervision of divers by MOF and/or AT Members or their associated staff.
